Support for those not covered by the RTA

Living arrangements that fall outside the RTA are generally covered by standard contract law and consumer protections.

People who aren’t tenants aren’t covered by the protections in the Residential Tenancies Act and can’t use the Tenancy Tribunal to resolve any disputes they might have.

This doesn’t mean that those people have no legal protections. Living arrangements that fall outside the RTA are generally covered by standard contract law and consumer protections. A lot of this will come down to the detail of what the parties agreed between each other, and what is reasonable.

As always, the best starting point is to discuss the issues with the other party to see if some agreement can be reached. If this is not possible, then either party can apply to the Disputes Tribunal to decide on the matter. For information about going to the Disputes Tribunal see here.

Citizens Advice Bureau and Community Law can help with next steps.
